These terms are effective as of 12th May 2025
TabNav Ltd. ("TabNav", or "We" or "Us") operates comprehensive digital accessibility solution designed to help businesses create more inclusive online experiences and conform to international accessibility standards (the "Services") through a website and any subdomains and related domain names (the "Site").
These terms of use ("Terms"), together with the Privacy Policy (which is available at www.tabnav.com/privacy-policy "Privacy Policy") constitute the entire agreement between users of the Site ("You" or "User") and TabNav in relation to Your use of the Services.
Please read these Terms carefully. By subscribing to, logging in, or otherwise using the Services, or using any part of the Site You agree, without limitation, to the Terms and Privacy Policy. If You disagree with these Terms and/or Privacy Policy and/or any condition thereof, please do not access the Site or use the Services.
By accepting the Terms, you also accept the privacy practices of the Privacy Policy. This means you grant us your consent to: (i) transmit your data to the service providers indicated in the Privacy Policy; (ii) store your data for the purposes and durations explained; and (iii) use your user's data to create a personalized user experience; (iv) agrees that TabNav may refer to You by your trade name and logo, and may briefly describe your business, in TabNav's marketing materials and website.
Please be aware that you are free to withdraw your consent at any time with future effect. For further information, please refer to the Privacy Policy.
By using the Services, you agree and accept the Terms. If you do not agree with the Terms or any condition thereof, please stop using the Site and any of the Services.
TabNav reserves the right to change, alter, replace or otherwise modify the Terms (including the Site's Privacy Policy) at any time. TabNav shall post a notice with respect to any updates in the Terms. You are advised to review the Terms regularly for any changes. Your continuance use of the Site and/or the use of the Services following the posting of any changes in the Terms constitutes acceptance of those changes.
The Terms apply to the use of the Site and the Services contained therein via any computer, tablet, cell phone or any other communication device.
In the Terms of Use, anything that appears in a masculine form shall also mean the feminine form and vice versa.
The preamble to the Terms constitutes an integral part thereof.
You are entitled to access the site and to use the Services subject to the provisions of the Terms.
You hereby declare that you are an individual either 18 years of age or more, have a capacity to engage with the TabNav in the Terms and takes full responsibility for the selection and use of the Services.
You hereby undertake to refrain from taking the following actions in relation to the Services and the Site:
Using the Services in an illegal manner or with the intention to violate any applicable law or in any manner prohibited by the Terms;
Making any alteration, modification or changes to the Site or the Services;
Interfering with the Site design, source code or any element of the Site or the inappropriate use of the intellectual property rights of any third party;
Removing or obscuring any proprietary notices on the Service;
Attempting to gain unauthorized access to any portion or feature of the Services, or any other systems or networks connected to the Services or to any TabNav's server, or to any of the services offered on or through the Services, by hacking, password "mining", or any other illegitimate means;
Using any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy reverse engineer, disassemble, monitor, decompile or otherwise attempt to discover any portion of the Services or any content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Services;
Probing, scanning or testing the vulnerability of the Services or any network connected to the Services, nor breach the security or authentication measures on the Services or any network connected to the Services;
Using the Site to distribute copy, reproduce, transmit, publicly display, publish, edit or create derivative works from any content that contains pornographic material, violent expressions, defamation, slander and hate speech, bullying and harassment including content that directly attacks people or shaming them based on their race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender, or gender identity, or serious disabilities or diseases;
Using the Site in a manner which is not in accordance with the Privacy Policy, with the Terms and with all applicable laws and regulations (including without limitation any local laws or regulations in the user's country, state, city, region, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data from the country or territory in which you reside privacy laws and regulations).
TabNav reserves the right to prevent a user who has violated any provision of the Terms from accessing or using the Site or accessing the Services.
TabNav reserves the rights to change, suspend or discontinue the Site or the Services at any time, including the availability of any feature, database, or content. TabNav may also impose limits on certain features and services or restrict your access to parts or all of the Site or the Services without notice or liability.
In order to access and use the Services, You will have to open a user account (the "Account"). When creating an account, you will be required to provide an email address and certain personal information about yourself and select a username and password (the "Login").
You shall be able to open an 'Admin' Account under which you may invite other users in your organization, using their email addresses, to join your Account as sub-users of the Account (an "Admin Account", and the "Sub-user", respectively). The Admin Account shall be able to manage the access and authorization of the Sub-user in the Admin Account.
The Account shall be activated after You have provided the TabNav with accurate and complete and updated registration information, which is necessary to use the Services. TabNav may ask you to provide with certain information for that purpose. TabNav reserves the right to refuse registration, or cancel an Account in its discretion. You shall be responsible for maintaining the confidentiality of your password and other Account information.
It is hereby clarified that despite TabNav taking measures to secure the Login, it cannot completely guarantee an unauthorized penetration into the Account and you will not hold TabNav liable for any claim of damages incurred as a result of unauthorized penetration to the Account.
Without derogating from any of the terms and conditions herein, You hereby undertake to act in accordance with the following terms in relation to the Account and the Login:
You are solely responsible for maintaining the confidentiality and security of the details of your Account including your Login, and you will remain responsible for all use of your Account and all activity streams from your Account, whether or not such activity was authorized by you.
You shall notify TabNav immediately of any suspicion that your Account has been accessed by unauthorized third parties or if your Login is lost or stolen. In such cases TabNav shall change the Login details at the earliest possible opportunity.
You have examined, before using the Services, and ensured that the Services are suitable for your needs, and you hereby waive any claim with respect to the Services not being fit for your needs.
You are solely responsible to verify before using the Services the condition of your internet connection – TabNav shall not bear any responsibility for damages that may be caused due to User's internet connection problems.
You shall be responsible for obtaining and maintaining any equipment or ancillary services needed to connect to, access the Services, including, without limitation, modems, hardware, software, and long distance or local telephone service. You shall be responsible for ensuring that such equipment or ancillary services are compatible with the Services.
TabNav will not be liable for any losses or damage arising from unauthorized use of your Account or password, and You agree to indemnify and hold TabNav harmless for any improper or illegal use of your Account, including any mail sent and any charges and taxes incurred unless you have notified Us via e-mail that your Account has been compromised, and have requested Us to block access to it. This includes illegal or improper use by someone to whom you have given permission to use your Account. We do not police for and cannot guarantee that we will learn of or prevent, any inappropriate use of the Site.
The Services offered to you through the Site includes use of TabNav's server that will enable you to:
The Widget Services. A JavaScript solution that dynamically enhances WCAG compliance in real-time. The widget automatically identifies and addresses accessibility challenges across 22-23 features, supporting 40 languages, and includes an accessibility statement. It remediates various WCAG barriers and failures dynamically on the User's website.
Under the Widget Services You will also be able to access:
Free Accessibility Widget: A no-cost widget that provides basic accessibility improvements, making digital inclusion accessible to businesses of all sizes.
Free Accessibility Checker: A quick diagnostic tool that provides instant insights into User's website's accessibility levels. The tool scans only 1 page.
The Scanning Services. An advanced dashboard tool that conducts extensive scans of websites, generating detailed reports on WCAG compliance levels and identifying potential accessibility issues. The platform includes collaborative features that function like an "Accessibility CRM", enabling teams to track, manage, and progressively improve their website's accessibility. During the scan, We emulate "real human" actions, to get the most accurate results, and providing a full description of issues, including the HTML selectors, location on the website, screenshots, and guidance for corrections
The PDF Services. An automated document accessibility remediation tool to ensure comprehensive PDF accessibility. Users can upload their PDFs through their Accounts. Once uploaded, the PDF will be auto-remediated and checked. At the end of the process, the User will receive the remediated PDF in return in the dashboard, including a report indicating the new accessibility score of the PDF, and the issues found.
You will be able to use the Services, by accessing the Site through your browser. The Services are fully supported on the following major browsers (i) Chrome, (ii) Firefox, (iii) Safari, and (iv) Microsoft Edge.
The following are the supported technologies that will allow User to access the Services (i) Websites that are compliance with HTML5 standards, and (ii) Standard HTML files and tags.
The following technologies and features are not supported by the Services:
Shadow DOM or Shadow roots;
Flash components;
Canvas elements;
Drag-and-drop functionality;
Cross-domain iframes or framesets; and
Third-party virtual services.
TabNav may from time to time develop patches, bug fixes, updates, upgrades and other modifications in order to add more features an to improve the performance of the Site and/or the Services ("Updates"). The Updates shall be subject to the terms and conditions of the Terms.
You can choose to opt out and to stop using the Services, stop receiving information, connecting you or receiving updates from TabNav and ask us to refrain from delivering your information to third parties, in the form and manner described in the Privacy Policy.
TabNav shall offer You the abovementioned Services separately, for each Service You shall Subscribe separately as detailed below.
Widget Services:
The Services are provided subject to a monthly/yearly subscription fee (the "Widget Fee"), that will be detailed in the Site, under the Account ordering the Services (the "Widget Service Order") and pay the fees associated with the Services (including without limitation, support fees for such Service).
The Widget Fees are billed each month/year, as per the terms under the Widget Service Order. Unless otherwise stated, all Widget Fees are quoted in the currency of the applicable jurisdiction in which the User subscribes to the Services and will be made automatically via credit card You provide under the Widget Service Order or as otherwise stated in the agreed payment terms in the Widget Service Order.
All payment obligations are non-cancelable, and all amounts paid are nonrefundable. The Widget Fees shall be chargeable upon invoice date and no receipt will be provided.
TabNav may suspend or terminate access to Widget Services if payment is not received, if fraudulent or unauthorized transactions are suspected, or if You violate these Terms.
The Widget Fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you are responsible for payment of all such taxes, levies, or duties, excluding only taxes based solely on TabNav's income. You are responsible for paying all taxes associated with your purchase of any Widget Services. If TabNav has the legal obligation to pay or collect taxes for which you are responsible, the appropriate amount shall be invoiced to and paid by you unless you provide TabNav with a valid tax exemption certificate authorized by the appropriate taxing authority.
TabNav reserves the right to modify the prices and fees and to introduce new fees upon thirty (30) days prior notice to you. Any such changes will only become effective upon renewal of a Subscription term (as defined below).
Scanning Services:
The Scanning Services offer limited usage for free. The limited free usage includes 1 page per scan per month. TabNav may, at its sole discretion and without prior notice, modify, suspend, or terminate the free usage limits at any time. Such modifications may include changes to the number of scans. TabNav is not obligated to provide any free usage and reserves the right to introduce, modify, or remove free access to the Services at any time without liability to the User.
If You wish to access the Services in excess of the limited free usage, You shall be required to purchase a yearly subscription and pay a fee as specified by TabNav (the "Scanning Fees" and together with the Widget Fee, the "Fees"). TabNav offers various plans and pricing options, which shall include additional scans.
By purchasing a paid plan, You agree to the pricing, payment terms, and billing cycles presented at the time of purchase as detailed in the Site, under the Account ordering the Services (the "Scanning Service Order", and together with the Widget Service Order, the "Service Order"). TabNav reserves the right to modify pricing, introduce new plans, or discontinue existing plans at any time.
Under the Scanning Service Order, You shall have a limited number of Scans for each month during the year, once you reached the limited, you will get a notification. Following such notification, You will be able to upgrade to a different plan to allow You to scan more pages per month.
If the monitor fails to scan all pages pursuant to issues with access including if You deny access to the geographical area of the server, or if the page is too large to load, or for any other reason, such pages will not be considered as "scanned", You will be notified of the pages that failed to scanned and You will be credited accordingly. Provided however that, TabNav shall not be liable for any failure of the Services due to User's access issues.
Payments are non-refundable unless otherwise required by applicable law or explicitly stated by TabNav. If You cancel a paid plan, You will retain access to the paid features until the end of the current billing period, but no refunds or credits will be issued for unused portions of the plan.
TabNav may suspend or terminate access to paid Scanning Services if payment is not received, if fraudulent or unauthorized transactions are suspected, or if You violate these Terms.
The Scanning Fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you are responsible for payment of all such taxes, levies, or duties, excluding only taxes based solely on TabNav’s income. You are responsible for paying all taxes associated with your purchase of any Scanning Services. If TabNav has the legal obligation to pay or collect taxes for which you are responsible, the appropriate amount shall be invoiced to and paid by you unless you provide TabNav with a valid tax exemption certificate authorized by the appropriate taxing authority.
Configuration, term, and pricing of the Scanning Services can be found in the billing section of your Account.
TabNav reserves the right to modify the prices and fees and to introduce new fees upon thirty (30) days prior notice to you. Any such changes will only become effective upon renewal of a Subscription term.
The PDF Services.
The PDF Services are subject to a fee for every page uploaded (the "PDF Fee") that will be detailed in the Site, under the Account ordering the Services (the "PDF Service Order").
Payments are non-refundable unless otherwise required by applicable law or explicitly stated by TabNav.
TabNav may suspend or terminate access to paid PDF Services if payment is not received, if fraudulent or unauthorized transactions are suspected, or if You violate these Terms.
The PDF Fee is exclusive of all taxes, levies, or duties imposed by taxing authorities, and you are responsible for payment of all such taxes, levies, or duties, excluding only taxes based solely on TabNav's income. You are responsible for paying all taxes associated with your purchase of any PDF Services. If TabNav has the legal obligation to pay or collect taxes for which you are responsible, the appropriate amount shall be invoiced to and paid by you unless you provide TabNav with a valid tax exemption certificate authorized by the appropriate taxing authority.

TabNav reserves the right to modify the prices and fees and to introduce new fees upon thirty (30) days prior notice to you. Any such changes will only become effective upon renewal of a Subscription term.
TabNav may offer You assistance in cases of litigation in connection with accessibility matters under your website as further described in the Site. This assistance will be provided at TabNav's sole discretion and in any event shall not constitute any legal advice or consult and you may not in any event rely on such assistance. Your use of any such assistance will be made under your own risk and hereby waive any claim or demand You may have against TabNav in connection with any proposed assistance.
If the prices are not displayed in the applicable Service Order, You will need to contact TabNav directly to receive a custom quote.
You agree that your purchases are not contingent on the delivery of any future release of new features, functionality, nor are your purchases dependent on any oral, written or public comments made by TabNav regarding such features, functionality, or services.
You hereby acknowledge and agree that all intellectual property rights, including without limitation copyrights, patents, trademarks, and trade secrets, made available through the Site and other than the open-source software mentioned in the Site, are owned by TabNav or its affiliates or licensors. TabNav and its affiliates and licensors and suppliers reserve all rights not granted in these Terms.
You may not create a service or product based upon any trade secret or proprietary information of TabNav and/or its licensors.
You hereby represent and warrant that: (i) with respect to all information You provide to the TabNav (such as, registration information, access to cookies etc., as described in the Privacy Policy), you have the full right and authority to make such provision and to allow TabNav to use such information to provide the Services (including, without limitation, for TabNav to provide such information to its data providers), (ii) none of the content transmitted, uploaded or otherwise distributed by it (or its partners or any third party) through use of the Services will infringe or otherwise conflict with the rights of any third party, and (iii) You have the full right and title to the User's website and You have the full authority to make any changes to it, and to allow TabNav to have access to it.
In case the User chooses to opt-out from the Site, to terminate his Account or in case the Account is terminated in accordance with TabNav decision, TabNav may, but is not obligated to, maintain the User's information for a period of twelve (12) months following the termination. After the said twelve (12) months period TabNav shall delete this information. If the User wishes to delete his information sooner, he must contact TabNav and ask for such deletion.
TabNav's current Privacy Policy is available at the Site, which is incorporated by this reference. TabNav strongly recommends that you review the Privacy Policy closely.
The Services, including, without limitation, the site and all content and services accessed through or via the site or otherwise, are provided "as is", "as available", and "with all faults".
While TabNav uses reasonable protection to correct any errors or omissions in the Services as soon as practicable once they have been brought to TabNav's attention, TabNav makes no promises, guarantees, representations or warranties of any kind whatsoever (expressed or implied) regarding the site, the Services or any part or parts thereof, any content, or any linked services. TabNav does not warrant that your use of the Services will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Services or any part or parts thereof, or the servers on which the Services operate are or will be free of viruses or other harmful components.
TabNav and its subsidiaries, affiliates, successors, and assigns, and their respective employees, agents, directors, officers and shareholders, specifically disclaim all of the foregoing warranties and any other warranties not expressly set out herein to the fullest extent permitted by law, including without limitation any express or implied warranties regarding non-infringement, merchantability and fitness for a particular purpose and you hereby waives such claim or warranty.
TabNav shall not be liable for any errors, inaccuracies, delays, service failures, or damages arising from or related to Third-Party Services, including but not limited to facial scan diagnostics and digital assistant functionalities.
Compliance with any CAPTCHA or similar user verification mechanisms remains solely Your responsibility. You shall ensure that any use of such tools on your Website or in connection with the Services complies with all applicable laws, regulations, and third-party terms.
Where the law of any jurisdiction limits or prohibits the disclaimer of implied or other warranties as set out above, the above disclaimers shall not apply to the extent that the law of such jurisdiction applies to the Terms.
TabNav and its subsidiaries, affiliates, successors, and assigns, and its respective employees, agents, directors, officers and shareholders, shall have no liability for any loss or damage arising from:
(a) your inability to access or use the Services, the site or any part or parts thereof;
(b) any changes that TabNav may make to the Site, the Services or any part thereof, or any temporary or permanent suspension or cessation of access to the Services, the Site or any content in or from any or all territories;
(c) any special, incidental or consequential damages;
(d) any errors or omissions in the Services technical operation, or from any inaccuracy or defect in the Services;
(e) your failure to keep your account details and your login suitably confidential;
(f) any loss or damage to any computer hardware or software, any loss of data, or any loss or damage from any security breach;
(g) any loss of profits or any loss you may suffer which is not a foreseeable consequence of TabNav breaching these Terms. losses are foreseeable where they could be contemplated by you and TabNav at the time you agree to these Terms, and therefore do not include any indirect losses, such as loss of opportunity; and/or
(h) any loss or damage caused by content of third parties published through the Site by users and third parties which may offend you or harm your systems in any way; and/or
(i) the use of non-standard HTML or code that does not comply with W3C guidelines.
TabNav shall have no liability for any failure or delay due to matters beyond its reasonable control.
Any claim or cause of action arising out of or related to your use of the Services must be notified to TabNav as soon as possible.
Applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such cases, you acknowledge and agree that such limitations and exclusions reflect a reasonable and fair allocation of risk between you and TabNav and are fundamental elements of the bargain between you and TabNav, and that the TabNav's liability will be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless TabNav and the respective employees, directors, officers, subcontractors and agents of each, against any and all claims, damages, or costs or expenses (including reasonable attorneys' fees) that arise directly or indirectly from: (a) breach of these Terms by you or anyone using your computer or password; (b) any claim, loss or damage experienced from your use or attempted use of (or inability to use) the Site, including any transactions that you conduct or attempt; (c) your violation of any law or regulation; (d) your infringement of any right of any third party; (e) the use of non-standard HTML or code that does not comply with W3C guidelines; and (f) any other matter for which you are responsible hereunder or under law. You agree that your use of the Site (including, without limitation, provision of services in connection with the Site) shall be in compliance with all applicable laws, regulations and guidelines.
TabNav may assign its rights and (where permissible by law) its obligations under the Terms, in whole or in part, to any third party at any time without notice, including without limitation, to any person or entity acquiring all or substantially all of the assets or business of TabNav.
The term of each Service Order is specified in the billing section of your Account or in the relevant Service Order (the "Subscription Term").
A Subscription Term will automatically renew for a subsequent renewal term of the same length, unless either party notifies the other party of its intent not to renew through a notification using the dashboard on the Site or through an email.
Either party may terminate this Agreement for cause (i) upon thirty (30) days' written notice to the other party of a material breach unless the breaching party cures such breach within fourteen (14) days of the date of such notice; or (ii) the other party becomes insolvent, enters into receivership, files a petition for bankruptcy, or any other proceeding related to the liquidation or assignment for the benefit of creditors.
If You choose to terminate the Account and/or Services, the Services and/or your Account (whichever is applicable) will no longer be accessible. Notwithstanding anything to the contrary, in case where the Services are terminated, any free Services will remain available. If you choose to terminate the Account, all Account information will be scheduled for deletion as soon as possible. Any cancellation request will be handled within thirty (30) days of receipt of such request. Without derogating from Section 6.4, upon any termination or suspension, TabNav will have no obligation to maintain any Account information, data or any related information that was stored and which is related to your use of the Services.
If this Agreement, or any individual Service Order, is terminated for any reason, You will pay any and all unpaid Fees covering the remainder of the current Subscription Term(s). In no event will any termination relieve You of any obligation to pay Fees owed to TabNav for the period prior to the effective date of termination.
The provisions of these Terms that are intended by their nature to survive the termination or cancellation of the Terms, including, without limitation, the provisions of the following sections: your use of the Services, compliance with the relevant provisions of the Privacy Policy, indemnification, limitation of liability, Assignment to Third Parties, and Applicable Law and Jurisdiction, respectively.
The Terms shall be governed by and construed in accordance with the laws of the State of Israel without regard to its choice of law rules, and any dispute or claim with respect thereto shall be submitted to the competent court in the District of Tel Aviv, Israel, which shall have sole and exclusive jurisdiction in such matter.
The foregoing provisions of with respect to the applicable law and jurisdiction do not apply to any claim in which TabNav seeks equitable relief of any kind. You acknowledge that, in the event of a breach of the Terms by TabNav or any third party, the alleged damage or harm, if any, caused to You, will not entitle You to seek injunctive or other equitable relief against TabNav, and your only remedy shall be for monetary damages, subject to the limitations of liability set forth in these Terms.
Should one or more provisions of these Terms be found to be unlawful, void or unenforceable, such provision(s) shall be deemed severable and will not affect the validity and/or enforceability of the remaining provisions of the Terms, which will remain in full force and effect.
